Rules and guidelines

Prohibited Conduct: I aim to take a common sense approach to this general code of conduct but you promise that you will not:

•  use a false email address, impersonate others, or misrepresent your affiliation with others.
•  post comments of an abusive or threatening nature or in anyway target another in a negative or upsetting manner.
•  submit false or misleading information
•  use information gathered from or through my websites in a way that may confuse or mislead others (for example, gathering information to set up a site that looks like one of my sites)
•  attempt to or actually interrupt, negatively impact or alter the website in any way.
•  use the content in a way that violates applicable law, that violates the intellectual property or other rights of myself or others, or that is fraudulent, obscene, unprofessional, offensive, misleading or defamatory;
•  modify, reproduce, display, publish, distribute, copy, transmit, perform, license, create derivative works from, transfer, or sell or re-sell any information, content, software, or item obtained from or through your purchases, my websites and the contents therein, other than in accordance with these terms. (See 'rights to make to sell' below under "Permitted Conduct")
•  use my or my businesses name, the name of anyone represented on the site or any Logos, trade or services marks in a defamatory, misleading or derogatory manner or in any way that might bring them into disrepute nor shall you misuse or deface any materials provided.

Permitted Conduct: As a customer you warrant and represent that:

•  Patterns and designs come with the rights to make to sell for hand embroidered items and you are permitted to use these designs as is or altered to create items to sell that are hand embroidered by yourself, your family members and persons within your household only and agree that designs altered to be offensive in any way will not be publicly associated with myself (Maxine Sapsford also known as 'Scarlett' hereafter referred to as "I" "myself" and "me") or the Stitch Gothica brand without permission.
•  You are responsible for the integrity of any content or information you post or submit which will be in all respects true, complete and accurate to the best of your knowledge and belief and that you shall promptly update or correct content or information on becoming aware of any errors or inaccuracies and shall make known to me and provide such assistance as I shall reasonably require to identify and remedy any unauthorised use of content. You also agree that you will not knowingly or wilfully submit inaccurate, defamatory or offensive content.
•  You agree to comply with all applicable laws and refrain from infringing any third-party rights or interests (for example, privacy and intellectual property rights).
•  You shall ensure that only yourself, your family members and persons within your household have access to the contents of your purchase unless permission has been sought and granted by myself (please email me details at stitchgothica@gmail.com if you are a teacher with students or have a stitching group you want to share specific info with) and any imagery uploaded is of your own work or if not, that details of the person who owns the work are clearly communicated and that you own the copyright or have obtained permission from the copyright owner to share the imagery.

Your responsibility: You promise that information you give is true, accurate and complete and that you will keep your account information up-to-date (including a current email address). Your purchase is not transferrable. You are responsible for any use of my sites and products that occurs in conjunction with your username and password. If you realise there's any unauthorized use of your password or any breach of security you need to let me know immediately.

Referrals: As a part of my Affiliate Program, if you refer a new member to my products linked in my Affiliate Program you will be eligible to receive an affiliate commission. You can find out more about the Affiliate Program and the terms that apply by emailing me at stitchgothica@gmail.com.

Payment Terms 

Payment Plans: If you have opted for a payment plan, payment will be taken each month from your chosen payment method on the day of the month you purchased. If you are outside of any respective money-back period stated on the sales page you are liable for the full payment of your purchase.

Cancellations and Refunds: You are not eligible for a refund unless within the initial 30 days where a 30 day refund policy was in place at time of purchase. All refunds will be given to the original payment method with which the purchase was made. Please allow a reasonable time for the refund to reach you or be charged back to your account.

Where The 30 Day Refund Policy Applies: For initial purchases advertised with a 30 day money back guarantee, you may cancel within the first 30 days and request a full refund by emailing me at stitchgothica@gmail.com with the subject line '30 Day Refund' either from or including within the email the email address associated with your membership.

Failed Payments: If your payment does not go through or gets declined for any reason it will usually be retried automatically a few times over several days without you needing to take further action.

Customer Submissions and Content

"Submission" means any photos, testimonials, reviews, or other content you voluntarily share with us through our website, email, or social media.

When you share a Submission with us, you grant Stitch Gothica a non-exclusive, royalty-free, revocable license to use, reproduce, and display your Submissions for the following purposes only:

•  Marketing and promotional materials
•  Social media posts (Instagram, Facebook, etc.)
•  Website testimonials and galleries
•  Educational content showing student work
•  Community features within our courses and membership

Your Rights: 

•  You retain full ownership of your content
•  You can request removal of your content at any time by emailing stitchgothica@gmail.com
•  We will not sell, license, or transfer your content to third parties for commercial purposes
•  We will credit you by name unless you request otherwise
•  You can withdraw this permission at any time (though content already published may remain until practically removable)

Our Commitment: 

•  We will use your content respectfully and only for purposes that support our embroidery community
•  We will not alter your work in ways that misrepresent your skills or our brand
•  We will remove your content within 30 days of a written removal request
•  We will not use your content for purposes unrelated to embroidery education and community building

Data Protection: 

Your submission rights are subject to our Privacy Policy and your rights under applicable data protection laws, including the right to request deletion of your personal data.

Intellectual Proprietary Rights 

As a customer you acknowledge and agree that I own all intellectual property rights to Stitch Gothica, the purchased course or membership, all related information and websites. Except as expressly stated herein, this Agreement does not grant the Member any rights to, or in, patents, copyright, database right, trade secrets, trade names, trade marks whether registered or unregistered, or any other rights or licences in respect of the membership subscription or it's information.

Confidentiality & Data Protection 

I shall implement and maintain reasonable procedures for protecting personal information in compliance with applicable law and my privacy policy.

Myself and the customer agree to keep any and all Confidential Information that is obtained about the other strictly confidential.

"Confidential Information" means any information or matter concerning the business, finances, technology or affairs of the other party which is not in the public domain (other than by breach of this clause) but shall not include any information that either party is required to disclose by law or which has come into the public domain other than by breach of this clause. This clause shall survive termination of the Contract.

Liability Disclaimer 

Should the website have to be discontinued due to conditions pertaining to injury, a country's legislation, a court decision or a prohibition by a country's public authorities, I will not be responsible for any losses to the individual customer which may ensue from this. I will, as far as possible, attempt to inform the individual customer quickly if circumstances described under this point should arise and refund customer where requested.

I reserve the right to unilaterally change the terms and conditions from time to time without giving further notice to the individual customer. Such changes will take effect when I publish them on my website.

I will use reasonable efforts to restore lost or damaged data from the latest website backup. However, I am not responsible for data loss caused by third parties.

I own the intellectual property for my websites, including trademarks, copyrighted content, creative content and other features. I can file a claim for infringement if a customer uses my intellectual property without permission outside of the permissions granted within these Terms of Use.

I make no express warranties or representations as to the quality and/or accuracy of the Content, the Websites, the Emails or the Services owned and sold by myself, and I expressly disclaim any implied warranties, conditions and/or representations, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the full extent permissible under applicable law.

I offer the Content, the Websites, the Emails and the Services on an "as is" basis and do not accept responsibility for any use of or reliance on the Websites, Emails, Content or Services, or for any disruptions to or delay in the Services. In addition, I do not make any representations as to the accuracy, comprehensiveness, completeness, quality, currency, error-free nature, compatibility, security or fitness for purpose of the Websites, Emails, Content or Services. I do not guarantee the adequacy of the Services or Websites or compatibility thereof to your computer equipment, mobile devices, or environment and do not warrant that the Websites, the Services, their servers, or any Emails which may be sent are free of viruses or any other harmful components. To the fullest extent permissible under applicable law, I limit my liability. In particular, I shall not be liable for any damages that I cause unintentionally and I shall not be liable to you for any actual, incidental, indirect or consequential loss or damage howsoever caused, provided that nothing in this Agreement will be interpreted so as to limit or exclude any liability which may not be excluded or limited by law. If you are dissatisfied with any portion of the Websites or the Services, or with any clause of these terms, as your sole and exclusive remedy you may discontinue using the Websites and the Services. This defense and indemnification obligation will survive this Agreement and your use of the Websites and Services.

I may, from time to time, provide opportunities to customer and users of my Websites to purchase services from third parties and I may also use affiliate links to do so. Websites of those third parties are subject to terms and conditions different from those applicable to my Websites and it is your responsibility to ensure that you have read and understood them. I make no warranty concerning and am not responsible for any third party provided goods or services, and you agree that any recourse for dissatisfaction or problems with those goods or services will be sought from the third party provider and not from myself.
